Two ethnic Shan women who were trafficked and sold as wives to Chinese men before being released in 2008 have now approached an UN agency to demand for help in rescuing the remaining victims.

Six women in total from Burma’s northeastern Shan state were sold for US$1,200 by a ring of Burmese human traffickers in 2008: three reportedly remain with their captors in China, while the third women released has since died of AIDS-related diseases.

The two now back in Burma are filing a report to the International Labour Organisation (ILO), which has offices in Rangoon. Previous reports filed to the Myanmar Women’s Affairs Federation and local police in Shan state were fruitless. Thet Wei, chairman of a Rangoon-township National League for Demcoracy (NLD) committee, is helping the women.

“All six were sold to become wives. [The traffickers] tricked them into going to China by promising jobs that pay 80,000 kyat [US$80] per month. After they arrived in China, they were sold to the Chinese men to become their wives,” he said.

It was only when relatives of three of the women travelled to China to confront the captors that they were released. The relatives reportedly cited the harsh penalties that China carries for human traffickers: in the past year, Beijing has returned more than 300 Burmese trafficking victims.

Julia Marip, of the Kachin Women’s Association Thailand (KWAT), said that about 60 percent of these were women sold for forced marriages, out of an estimated total of 50,000 women each year bought by Chinese men.

“If you look at the root of the human trafficking problem, you’ll see that [Burma] is in a very bad situation with economic downfall and poverty. These issues must be dealt with first in order to effectively handle the human trafficking problem,” she said.

Burma became one of the signatory countries to the UN Anti-Human Trafficking agreement in early 2004,. The country also has its own anti-human trafficking laws, which at the of June this year saw a racket in Magwe division’s Chauk township being handed 15-years prison sentences for selling a 16-year-old girl to Chinese men.

A US report in 2009 said that trafficking of Burmese women into forced marriages was “a major problem”, although the UN’s resident coordinator in Burma, Bishow Parajuli, said in January this year that the Southeast Asian pariah had made good progress in the past six years.

China and Malaysia remain the top destinations for women sold as wives to men. The US report cited statistics released by the ILO that estimate that at least 12.3 million people worldwide are in forced labour, bonded labour or commercial sexual exploitation.

Statement by the International Trade Union Confederation Conference “Building
Solidarity with Burmese workers, Tokyo”,11-12 February 2010


The 5th international trade union conference on Burma hosted in Tokyo by the
JTUC-RENGO was held in order to prepare for the ITUC’s upcoming Congress in
Vancouver in June 2010, where the future strategy of the international trade union
movement with regards to Burma will be decided.
The Conference was a working session on all the strategic options available to the
international trade union movement ahead of the announced elections in Burma in
2010. The possibility that certain governments may shift their policy towards Burma in
the wake of the elections and the international trade union movement’s policy response
were discussed. In the absence of constitutional change and dialogue, the Conference
affirmed that the elections could not be considered legitimate, It expressed its firm
opposition to the 2008 constitution adopted by the regime, and called for meaningful
dialogue before elections are held.
The Conference reaffirmed the conclusions and the solidarity expressed in 2007 during
the 4th Burma Conference held in Kathmandu and called for a strengthening of the
commitment undertaken in 2007 for the restoration of democracy and to combat the use
of forced labour in Burma. The Conference welcomed the efforts undertaken by
affiliates in the region and globally to raise awareness with their governments about
workers’ rights and democratization in Burma.
Forced labour is still prevalent in Burma despite the ILO Commission of Inquiry in
1998 and people reporting cases of forced labour continue to be persecuted. Even after
the conclusion of the Supplementary Understanding in 2007, giving immunity to
victims and complainants, people have been arrested and too many remain in prison.
The Conference expressed outrage at the continued reprisals against complainants and
against the fact that the present number of detainees were as high as 23.
The Conference welcomed the holding of the first congress of the FTUB in March 2009
and the subsequent affiliation of the Burmese trade union to the ITUC and the
ITUC-AP in 2009. The Conference expressed the urgent need to address more
aggressively the situation with regards to freedom of association in Burma. The
Conference stressed that while it was important to maintain the pressure on the issue
of forced labour it should be considered, how the issue of freedom of association could be
given greater attention, especially within the framework of the ILO. It therefore
proposed tabling a complaint leading to the establishment of an ILO Commission of
Inquiry on freedom of association in Burma.
The discussion happened against the backdrop of an increasing number of strikes in
Burma by discontented workers and growing divisions within the military. In the course
of the Conference, the FTUB received information about a strike by 12000 workers
inside Burma.
The overall strategy within the ILO was discussed in depth, both with regards to forced
labour and freedom of association. The Conference reaffirmed its strong support for the
decisions of the ILO Governing Body and the Conclusions of the 2006 ILC Selection
Committee to pursue a referral to the International Court of Justice.
The strategy with regards to investment in Burma was the subject of serious
discussions. The Conference reaffirmed the commitment towards divestment and to
maintain pressure on all companies operating in Burma as their operations directly or
indirectly serve to prop the illegitimate regime. It was proposed that the different
database and information sources on pension funds and companies investing and/or
operating in Burma be better coordinated to bring more aggressively targeted pressure
to bear.
The Conference concluded that there was a need to aggressively follow-up on the call by
the ILO to Governments, Workers and Employers to take all “appropriate measures to
ensure that the said member cannot take advantage of such relations to perpetuate or
extend the system of forced or compulsory labour referred to by the Commission of
Inquiry… and report back in due course and at appropriate intervals to the Governing
Body” within the framework of its Resolution adopted in 2000.
The Conference reiterated the resolve of the international trade union movement to
support the struggles of our Sisters and Brothers in Burma and their capacity through
the FTUB to carry out their just fight for democracy and workers’ rights. The
Conference agreed a plan of action to strengthen the capacity of the FTUB by providing
support for a reinforcement of its structures. It finally committed to mobilizing support
amongst ITUC affiliates for the funding of an expansion of FTUB’s activities and
training programs.

Burma: Historic Trade Union Congress Reaffirms Campaign for Democracy and Workers’ Rights

Brussels, 24 March 2009 (ITUC OnLine): An historic three-day Congress of the Federation of Trade Unions of Burma (FTUB) concluded on the Thai-Burma border today, with the adoption of the organisation’s new Constitution, and the re-election of U Hla Oo as President and Maung Maung as General Secretary. The FTUB, which was founded in 1999, has been at the forefront of the struggle for democracy and human rights since its inception. The Constitution confirms the status of the FTUB as an independent, democratic trade union organization, committed to bringing about respect for labour rights, in particular the standards of the International Labour Organisation, for all Burmese workers.

Congress delegates expressed their thanks to the international trade union movement for the strong solidarity shown by trade unions across the globe in support of their Burmese colleagues, and pledged to strengthen cooperation with trade unions around the world.

A key feature of the Congress was the re-affirmation of the FTUB’s commitment to and end to military rule and the introduction of democracy. The Congress called for a boycott of the military’s sham “elections” in 2010, which are intended to bring a measure of credibility to the regime without it having to concede the absolute power that it currently holds. The Congress also pledged to carry on the fight against the systematic use of forced labour by the military, with evidence that the regime has been using forced labour on reconstruction projects following the devastating Cyclone Nargis of May 2008.

The FTUB also maintained its call for economic sanctions against the military junta, noting that 90% of the people of Burma have to live on less than 1US$ per day, and that the only people gaining any real benefit from Burma’s trade and economic relations with other countries are the small minority of the population who run the regime and their closest supporters.

“The FTUB comes out of this Congress strong, unified and determined to work for a better future for Burmese workers and the entire population of the country. The Federation clearly has extremely strong support within the country, despite the ongoing harassment and brutality of the regime towards anyone who they suspect of supporting genuine trade unionism. The ITUC and its international partners will continue and strengthen our support to the FTUB in its struggle for democracy, justice and workers’ rights,” said ITUC Deputy General Secretary Jaap Wienen, who represented the Confederation at the Congress.
