YANGON, Feb 3 (Reuters) - U.N. envoy Ibrahim Gambari wound up his latest visit to Myanmar on Tuesday having failed to make any headway in his bid to coax detained opposition leader Aung San Suu Kyi and the junta towards talks on political reform.


During a meeting with Gambari, Suu Kyi and her National League for Democracy (NLD) made it clear they would not bend from the line that 1990 elections, won by the NLD but dismissed by the generals, must be the basis of any settlement.


The junta insists elections will be held next year under the closing stages of a seven-point "roadmap to democracy" that nevertheless confers ultimate control of the former Burma on the military, which has ruled since a 1962 coup.


"The NLD are still sticking to the same old stance. They haven't changed their game plan at all," one veteran politician, who declined to be named, told Reuters.



"I'm so sorry for the country, for the people, especially the young ones. I don't know how much longer we will be stuck in this deadlock. Gambari cannot be blamed for this. After all, he isn't a magician," the former politician said.


On the junta's side, the most senior official Gambari met was Prime Minister Thein Sein, number four in the military hierarchy.


Amid talk of a possible visit by U.N. Secretary General Ban Ki-moon to kickstart the non-existent negotiations, the NLD also insisted it would not welcome Ban before the release of all political prisoners, including Suu Kyi.


The Nobel peace laureate, who has been in prison or under house arrest for 13 of the last 19 years, is among 2,162 people believed to be in detention because of their political or religious beliefs.

Suu Kyi sets peace terms

YANGON: Myanmar's detained democracy leader Aung San Suu Kyi yesterday met visiting UN envoy Ibrahim Gambari, outlining conditions for dialogue with the junta as the diplomat struggled to make a breakthrough. Gambari is in Myanmar to try to push all sides in the military-ruled nation toward dialogue on democratic reform, after his last visit in August ended in deadlock with Suu Kyi refusing to meet him.

The junta has also shown little sign of embracing the Nigerian troubleshooter's role, and he is not expected to meet reclusive head of state Senior General Than Shwe during his four-day visit, which began on Saturday.

Yesterday, Suu Kyi was allowed out of the lakeside home where she has been kept prisoner for most of the last 19 years to meet Gambari and five senior members of her National League for Democracy (NLD) party.



Suu Kyi expressed frustration over the world body's failure to persuade the junta to give up their monopoly on power, her party said.

She told Gambari that any visit by UN Secretary General Ban Ki-moon should be conditional on the release of her and all political prisoners, NLD spokesman Nyan Win said, while the party also reiterated its stance.

"Our demands are the release of all political prisoners, a review of the constitution, call the People's parliament and also dialogue," said Nyan Win.

People's parliament refers to the landslide election victory by Suu Kyi and the NLD in 1990 - an outcome that was ignored by the junta, with the military instead cementing its now nearly five-decade grip on power.

Nyan Win said Suu Kyi also raised the plight of more than 270 pro-democracy activists recently jailed for up to 104 years.

"She pointed out that the long prison sentences, such as 65 or 100 years, were handed down with no defence and no lawyers allowed," Nyan Win said.

ガンバリ氏がビルマを訪問へ

・国連のガンバリ事務総長特別顧問が31日から4日間の日程で
ビルマを訪問することが明らかになった。アウンサンスーチー氏が
書記長を務める国民民主連盟(NLD)によれば、氏がガンバリ氏と
会う可能性もある(29日付イラワディ誌)。
民主化勢力の間で特使の訪問に対する期待は低い。

【その他】

国全体で600万人に食糧援助が必要、ほか

・1990年総選挙で当選した議員らがダブリンで総会を開き、
亡命政権のビルマ連邦国民連合政府(NCGUB)の首相に
現職のセインウィン氏を再選した。同じく現職の3人に加え
新たに3人が大臣となり、大臣は合計7人になった
(26日付DVB)。

・ビルマの通貨チャットが闇レートで3年ぶりの高値となる
1ドル約1000チャットにまで上がった。原因としてはタイや
インドとの国境貿易の低迷、外国からの投資額の増加や
サイクロン関連援助資金の送金などがあるとされる
(26日付イラワディ誌)。

・サイクロンの被害が大きかったイラワジデルタ地域で、
漁業や農業などに従事する15歳以下の子どもが増えていると
現地の民間団体筋が述べた。大人より低賃金なわりによく
働くため雇用主も好んで雇うという
(23日付イラワディ誌)。
また国連世界食糧計画(WFP)は、サイクロン被災地域を
含むビルマ全体で600万人が食糧援助を必要としていると報告した。
軍政が課す諸制限のため、ビルマ西部のロヒンギャ民族や
チン民族居住地域など援助機関が入れない地域もある
(28日付BBCニュース)。

・27日にタイ沖で拘束されたロヒンギャ民族78人のうち未成年の
12人について国連難民高等弁務官事務所(UNHCR)が面会
することをタイ政府が認めた。健康状態などは良いとのこと。
残り66人は不法入国で有罪判決を受けた
(29日付AFPほか)。

(バンコク、2009年1月28日) - 「ビルマ軍事政権は、ビルマ西部チン州に住むチ
ン人に対する人権侵害を止めるべきである」ヒューマン・ライツ・ウォッチは本
日発表の報告書でこのように述べた。また、インド政府と選挙を終えたばかりの
ミゾラム州政府に対し、ビルマでの継続的な迫害と厳しい弾圧を逃れて隣国イン
ドに避難してきたチン人を保護するよう求めた。

本報告書「『まるで忘れられた民だ』:危険なビルマ、保護のないインド」
('We Are Like Forgotten People': Unsafe in Burma, Unprotected in India、
全93頁)で、ヒューマン・ライツ・ウォッチは、ビルマ軍と政府当局者による広
範な人権侵害の実態(強制労働、恣意的逮捕・拘束、拷問、宗教弾圧、基本的自
由への制限など)を記録。インド側のミゾラム州では、チン人は、現地のミゾ人
組織や当局による差別や迫害の対象となり、ビルマ側に強制送還される危険に直
面している。

「本当に長い間、チンなどの民族グループは、ビルマの残虐な軍政支配の犠牲に
なってきた。ビルマ国軍は、こうした非人道的な扱いをやめるべきだ。そして、
ビルマ軍の残虐行為に対する責任追及が必要だ。またインド政府は、必死で庇護
を求める人々を保護する方向にかじを取るべきだ」ヒューマン・ライツ・ウォッ
チのアジア局長代理エレーン・ピアソンはこのように述べた。

今回発表された詳細な報告書は、2005年~2008年に行なわれた広範な調査に基づ
いている。ヒューマン・ライツ・ウォッチは140件ほどの聞き取りを行ない、チ
ン州に住みながら商売のためにミゾラム州に来ている人や、ビルマから完全に逃
れた人々(大部分が数年以内に)から聞き取りを行った。本報告書は、ビルマの
「忘れられた民」の惨状の一端を知る貴重な情報となっている。

ビルマ軍政は、反体制的な政治活動を抑え込み、恫喝を加えるために、チン人を
日常的に逮捕・拘束している。ビルマ軍はチン人の生活の多くの面に制約を加え
ている。移動の自由の制限、金銭・食糧・財産の日常的な没収や恐喝、強制労働
の徴用、特定作物の栽培の強要などだ。あるチン人男性はヒューマン・ライツ・
ウォッチに対して「私たちはまるで奴隷だ。(軍の)命令にはすべて従わないとい
けない」と語った。

本報告書『まるで忘れられた民だ』には、反政府組織「チン民族戦線」(CNF)と、
その軍事部門「チン民族軍」(CNA)によるチン人住民への嫌がらせや暴行、恐喝
などの人権侵害も記録されている。ミゾラムに住むチン人のキリスト教会指導者
の一人は「反政府組織がいてくれて助かるというよりは、むしろそのせいで生活
がより大変になっている」と語った。ヒューマン・ライツ・ウォッチはビルマ国
軍と、武装組織の双方に対し、人権侵害行為を停止するよう求めるとともに、ビ
ルマ軍政=国家平和発展評議会(SPDC)に対し、人道援助機関のチン州への自由な
アクセスを許可することを求めた。

チン人農民やその家族は、日常的に畑仕事の中断を余儀なくされている。ビルマ
軍の物資を運ぶポーターとして動員されたり、道路や兵舎や監視所などの軍事施
設の建設に動員されるからだ。これにより、ビルマ最貧州の一つであるチン州、
とくにネズミの大発生を原因とする食糧不足と飢餓に苦しむ地域に住むチン人が
生き延びる力はさらに弱められている。さらにビルマ政府の援助規制によって、
危機にさらされた住民を支援しようとする援助機関の活動が制限されている。

ピアソンは「チン州の飢饉は自然災害であり、援助規制と強制労働によって災害
の被害は悪化する一方だ」と語った。人権侵害が原因で、数万のチン人がビルマ
を逃れ、多くが、必要な旅行文書なしに隣国インドのミゾラム州に非正規入国し
ている。しかし現地のボランティア団体や州政府当局者は、チン人をたびたびビ
ルマに強制送還している。

この行為は国際法の下でインドが果たすべき義務、すなわち生命または自由が脅
威にさらされるおそれがあるか、迫害の恐れがある国に人を送還してはならない
という原則に反するものだ。ビルマから逃げてきたチン人の多くは難民の資格に
該当するにも拘わらず、国連難民高等弁務官事務所(UNHCR)は国境のチン人にア
クセスすることができない。したがって、2,460キロ先のデリーのUNHCR事務所ま
でたどり着いた人だけしか難民申請できない。インドは難民の地位に関する条約
(1951年)の締約国ではないが、拷問等禁止条約(1984年)には署名している。

ミゾラム州でどうにか暮らすことができているチン人たちも、宗教迫害の対象と
なり、住居と教育へのアクセスに関して厳しい差別を受けている。

ヒューマン・ライツ・ウォッチはインド政府に対し、チン人の庇護希望者と難民
を保護し、UNHCRがこうした人々を難民登録できるよう、UNHCRのミゾラム州への
アクセスを許可することを求めた。2008年12月2日に行われたミゾラム州の議会
選挙では、インド現政権の与党・国民会議派が大勝し、同州では10年ぶりに政権
に復帰した。ミゾラム州の同党議員らはこれまでもチン人移民の排斥を求めてお
り、ビルマでの人権侵害から逃れた人々の窮状に対して、前政権よりも冷淡とも
いえる態度を取ってきた。

「インド政府はチン人の悲惨な状況を無視すべきでない。人々を保護し、ビルマ
への強制送還につながるあらゆる行動やイニシアティブを防止すべきである。今
も続くチン人差別にいかに対処するかが、ミゾラム州の新政権にとっての試金石
となる」ピアソンはこのように述べた。

今回の報告書は、東南アジア諸国連合(ASEAN)加盟国や米国、欧州連合(EU)など
国際社会に対し、ビルマ軍政からの無用な干渉なしで提供が可能であるという条
件つきで、チン州への人道援助の増強を訴えており、またビルマ政府が具体的な
人権状況の改善を行わなければ、対象限定制裁を強化することも求めた。

「チン人は、ビルマでは危険にさらされ、インドでは保護されていない。チン人
への人権侵害がインドの中心部からもビルマの中心部からもはるか遠くで起きて
いるというだけの理由で、チン人が「忘れられた民」のままでいるのは許されな
い。ASEANやEU、米国は、ビルマ、インド両政府に対し、こうした侵害行為を一
刻も早く停止すべきと伝えるべきだ」ピアソンはこのように述べた。


以下は、今回の報告書作成の際に行ったチン人への聞き取りからの抜粋である。


「ビルマ軍から何度もポーターを命じられました。10回以上です。荷物が持てな
いと殴られるのです。[兵士たちは]腹を立てて、わたしたちを平手打ちにし、
蹴るのです。そしてもっと速く歩けと命令します。ふつう1回のポーターは2、3
日です。拒否することはできません。一度だけ断ろうとしたことがあります。疲
れがひどかったのと、運ばされる荷物がとても重かったからです。できませんと
言おうとすると殴られました。そして「お前たちの生き死にはわれわれ次第だ。
つべこべ言わずにやれと言われたことをやれ」と言われました。

「[警察から]棒で殴られました。銃の台尻で殴るのです。口を殴られ、前歯が
折れました。頭を切られ、大量の出血がありました。そして何度も何度も台尻で
殴られました。背中の傷はまだ完治していません。重い荷物を背負うのも大変で
す。電気ショックもやられました。警察はバッテリーを持ってきて、私の胸にク
リップをつけるのです。そして電気のスイッチを入れ、私の意識がなくなるとス
イッチを切る。これを数時間やり続けるのです。牧師の息子にも、同じことをや
っていました。チン民族軍(CNA)に関する情報を提供しなければ許してやらない
と言ってきました。しかしわたしたちは何も知らないと答えるしかありませんで
した。
――チン人男性(ザガイン管区出身)。チン民族軍(CNA)との関係を疑われ、警察
に逮捕され、拷問を受けて3日間拘束された際の体験を語った。


「ビルマ軍は繰り返し鳥や米を強要してきます。村にやってきてはよこせという
のです。少しは抵抗してみることもありますが、向こうは何も気にせず持ってい
ってしまいます。わたしたちの前で鳥を絞めて、みんな持って行ってしまうので
す。」
――女性(18歳、チン州マトゥピ郡出身)。2008年にビルマを離れた。


「[ミゾ人のなかには]わたしたちの弱みにつけ込んで、お金を要求し、もし払
わなければ、警察や青年ミゾ同盟(YMA)に密告すると脅す人がいます。わたした
ちが視界に入るのがそもそも気にくわなないとケンカを売られることや、暴行を
加えると脅されることもあります。ここでの生活は地獄のようです。自分たちを
守ることさえできないのです。もしそんなことをしたら、もっと大変なことにな
るでしょう。身を小さくして、危険を避けることしかできません。ビルマ出身者
だということは、差別されるということなのです。」

New Delhi (Mizzima) - Burma’s detained opposition leader Daw Aung San Suu Kyi and her party – the National League for Democracy – on Monday said their meeting on Monday with visiting United Nations special envoy Ibrahim Gambari cannot be considered a ‘positive step’ as they need to assess the overall result of his visit.

Nyan Win, the NLD spokesperson, told Mizzima that Aung San Suu Kyi and five NLD CEC members on Monday met Gambari for about an hour at Seinle Kantha Guest House in Rangoon.

“We cannot consider the meeting a positive step, because we need to assess the overall result of the visit,” Nyan Win told Mizzima.

Nyan Win said Aung San Suu Kyi and the NLD CEC members, during their meeting, reiterated the need to apply more pressure on the government to release all political prisoners, to review the constitution, to recognize the 1990 election result and to convene the parliament based on it.



“The NLD has maintained the four points that we demand but Daw Suu and the five CEC members told him that the release of all political prisoners would be the minimum condition,” Nyan Win said.

The NLD leaders, however, said the release of all political prisoners would be the minimum condition that could be called a tangible progress to a question raised by Gambari on what would be the minimum condition for Ban Ki-moon to consider visiting Burma, Nyan Win added.

The world body chief late last year announced that while he would like to consider visiting military-ruled Burma, it will not be possible unless there are signs indicating that there are positive changes, beginning with the release of political prisoners.

On Gambari’s question on the 2010 election, the NLD leaders said they do not consider it legitimate and thus do not feel it necessary to discuss it.

“There is no reason for the NLD to talk or discuss the 2010 election,” Nyan Win said.

Nyan Win, however, said the NLD considers their separate meeting with detained leader as a positive step, as they could discuss party policies and activities ahead.

“The NLD leaders were able to discuss alone before the meeting with the envoy and that is really good for us because they were able to discuss party matters. But we cannot talk about anything yet,” he added.

The meeting on Monday, however, did not include veteran politician and senior party leaders Win Tin and Khin Maung Swe, who were released from prison in September 2008.

According to a source, the Burmese Ministry of Home Affairs categorically asked the NLD not to include Win Tin and Khin Maung Swe among the five CEC that were allowed to meet.

Gambari on Tuesday will be leaving for Naypyitaw, but it is still uncertain whether he can meet junta supremo Snr. Gen Than Shwe, who also did not meet Gambari during his last visit in August. http://www.mizzima.com/

YANGON, Myanmar: The detained Burmese opposition leader, Aung San Suu Kyi, expressed frustration to a UN envoy Monday over the organization's failure to persuade the country's military leaders to give up their monopoly on power, her party said.

The Nobel laureate in peace, who has spent more than 13 of the past 19 years under house arrest, was briefly allowed out Monday for a meeting with the UN representative, Ibrahim Gambari.

Nyan Win, a spokesman for Aung San Suu Kyi's National League for Democracy, said that during the meeting she had explained to Gambari that "she was ready and willing to meet anyone" to achieve political reform but "could not accept having meetings without achieving any outcome."



Aung San Suu Kyi's party has charged that Gambari's seven visits since 2007 have produced no tangible democratic progress, noting that they have not persuaded the junta to release political prisoners or to hold talks with the democratic opposition.

In August, Aung San Suu Kyi snubbed Gambari by failing to keep an expected appointment with him and refusing to open the gates of her Yangon home to his representatives. The gesture was surprising because Aung San Suu Kyi's house arrest keeps her in extreme isolation, and Gambari is one of the few outsiders - other than her lawyer and doctor - allowed to see her.

Gambari arrived Saturday for a four-day visit. He said earlier that his objectives were to urge the junta to free political prisoners, discuss the ailing economy and revive a dialogue with Aung San Suu Kyi.

Nyan Win said Aung San Suu Kyi also told the UN official that rule of law does not exist in Myanmar and referred to lengthy sentences given to political prisoners, the arrest of defense lawyers and other actions by the junta.

He said the UN secretary general, Ban Ki Moon - who visited in May after Cyclone Nargis devastated coastal areas - should not make any further visits until Aung San Suu Kyiand other political prisoners have been released.

It was unclear whether Gambari would meet with the junta leader, Senior General Than Shwe, who has shunned him on his last three visits.
